1. General Provisions

1.1 These Terms and Conditions outline the rules and regulations for the use of FANSPIRAL B.V.’s web page, located at https://fanspiral.com/ (hereinafter: the “Web page”).

1.2 The owner and administrator of the Web page is FANSPIRAL B.V. (hereinafter “FANSPIRAL”),

2.4 Users may need to create an account in order to use the Services. The user is solely responsible for the safeguard of the account and the actions taken with such account.

3.1 You are responsible for the content that you use or provide in use of the Services. You hereby warrant that such content is in accordance with the applicable rules and regulations and these Terms of Use, and is not infringing other people’s right.

3.2 The use of the Services is at you own risk. You may encounter content that is offensive, harmful, inaccurate or otherwise inappropriate. FANSPIRAL does not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content on the Web page or the Services or endorse any opinions expressed via the Services. FANSPIRAL does monitor the content on the Web page and the Services, but is not responsible for such content and cannot be held liable for any damage incurred thereby.

3.3 Users retain the rights to the content that they submit to the Web page and the Services.

3.5 FANSPIRAL reserves the right to remove or delete any content on the Web page or the Services without any notice or warning, and without stating the reasons thereof.

4. Conduct

When using the Services, users have a duty to behave in accordance with a reasonable person standard.

5. Privacy and data processing

FANSPIRAL may process user’s personal data. Users hereby accept and agree to our privacy policy https://help.fanspiral.com/privacy. Users hereby grant permission for the processing of their personal in accordance with the privacy policy.

6. Liability and dispute resolution

6.1 FANSPIRAL is not liable for any damage incurred by the user of the Services, unless such damage is the result of intent or gross negligence (in Dutch: “opzet of bewuste roekeloosheid”).

6.2 In the event FANSPIRAL is liable to the user of the Services, the liability is limited to the amount of EUR 1.000,00.

6.3 Users hereby indemnify and shall hold harmless FANSPIRAL for any damage incurred by FANSPIRAL as a result of any breach of these Terms of Use and applicable rules and regulations by the user, such as (but not limited to) any Content that is in violation of any applicable rules and regulations.

6.4 Disputes will be exclusively resolved by the competent court in Amsterdam in accordance with the laws of The Netherlands. The agreement, these Terms & Conditions and any disputes resulting from or in relation to these are exclusively governed by the laws of The Netherlands.
